MUSAWA Supports the Demand of the Palestinian Bar Association to Subject Judges’ Performance to Accountability and Evaluation Systems
MUSAWA- The Palestinian Center for the Independence of the Judiciary and the Legal Profession supports and endorses the request of the Palestinian Bar Association to subject Judges’ performance, including those who retired recently, to a process of comprehensive evaluation and accounting, to ensure that the performance of incompetent judges does not affect the chance of their competent counterparts to head the Supreme Court. MUSAWA believes that this request complies with its statement on the decree-laws No. 16 and 17 of 2019, and corresponds to its reform vision that was reflected in its announced initiative. MUSAWA reiterates that the advocated evaluation process shall be professional and inclusive, shall be applied on all judges and employees of the Justice System bodies, particularly the Constitutional Court and the Public Prosecution, shall be inclusively implemented from the top down, and shall be carried out by a social body chosen by the consensus of the society on the basis of their impartiality and the societal trust in its members, away from any control from the Executive Authority, which raises the need to abolish both the aforementioned decree-laws.
