Respected ladies and gentlemen of the Bar Council,
Subject: Bar Association's opinion on Decree-laws amending the judicial legislations, the enforcement of which is deferred until first of June
MUSAWA- The Palestinian Center for the Independence of the Judiciary and the Legal Profession expresses its greetings and demonstrates that, despite its commitment to its legal position opposing the issuance of Decree-laws, it demands that in light of the working mechanisms followed by your distinguished Council with regards to Decree-laws, and the Bar Association’s membership in the Formal Justice Sector Coordinating Council, which recommended the deferral of the enforcement of Decree-laws amending some of the judicial legislations until first of June; the thing that enables the Bar to clarify its observations on these Decree-laws by amending them in consistency with the Bar’s vision, which lead to the issuance of a Decree-law deferring the enforcement of these Decree-laws, and giving the Bar the opportunity to express its vision concerning the texts contained in these Decree-laws, and today is the nineteenth of May and the Bar is almost out of time to submit its written memo in this regards, an in order not to encounter the scheduled enforcement of Decree-laws, and for its supporters not to justify introducing any amendments thereto alleging that the Bar fell behind submitting its memo, MUSAWA therefore requests that you submit your memo on the aforementioned Decree-laws as soon as possible and without delay, and in accordance with what you deem consistent with the Basic Law, and the rights and interests of the lawyers and litigants, and in a manner that safeguards the rule of law, fair trial guarantees, and the right to access to justice.
