Human Rights Organizations Submit a Penal Notice to The Attorney General to Investigate the Assaults on Participants in Peaceful Gatherings

On July 1, 2021, a group of Human Rights Organizations submitted a penal notice, calling for a comprehensive investigation into the assaults perpetrated by plain-clothed groups during the peaceful gatherings that were held on Thursday, June 24, 2021, and Saturday, June 26, 2021, as well as on Sunday, June 27, 2021 in the city of Ramallah. This came in light of the human rights organizations documenting the assault on citizens, which included women, men and elders. The assaults featured beatings with stones, sticks, batons and dragging on the ground. It also included the seizing of mobile phones, and the arrest of a number of participants in those gatherings where the plain-clothed individuals handed them over to the security services present in the place without interference from them or any protection of the demonstrators, in clear violation of the laws and legislation regulating the work of these services.

In light of these field follow-ups, human rights organizations documented violations through personal testimonies from citizens, in addition to live observations in the field made by field monitoring and documentation teams of human rights organizations, which represented serious violations of the constitutional rights guaranteed to citizens in the Palestinian Basic Law and international human rights conventions that Palestine acceded. The institutions stressed in their penal notice that those rights must be respected and all perpetrators of violations held accountable.

In their penal notice, the organizations clarified that the violations that the participants in the gatherings were subjected to constitute constitutional crimes described under Article (32) of the Palestinian Basic Law of 2003, crimes that neither criminal nor civil lawsuits arising from it are subject to a statute of limitations, and according to which the Palestinian National Authority guarantees a fair compensation for those who have been harmed. Furthermore, these violations are considered a crime of forming armed gangs under Article (158) of the effective Penal Code No. (16) of 1960.

Pursuant to the provisions of Article (24) of the Code of Criminal Procedure, the human rights organizations called upon the Attorney General, to start a comprehensive investigation of all the assaults committed against the female and male participants over the three days mentioned, and to take the necessary legal requirement in accordance with the applicable legal procedures. 

His Excellency the Attorney General welcomed in his office in Ramallah a delegation representing the organizations signatory to the notice, where they handed the notice to him. In turn, he expressed his interest in it and stressed the role of the Public Prosecution Office in protecting the rights and freedoms of citizens, and that it will perform the role assigned to it in accordance with the law, and follow up on the notice, as it will not evade its responsibilities.
