Legal memo to:
Attorney General Dr. Ahmad Barrak
Complaint from:
Citizen Mohammad Jamil Ibrahim Mansour
Subject:
“Failure to Enforce Judicial Ruling”
Memo date:
13/05/2018
Brief description:
On 13/05/2018, MUSAWA received a complaint stating that the aforementioned complainant was rendered a verdict by the interim relief judge, dated 24/09/2017, to stop the acts of bulldozing and construction on the complainant’s land, located in the village of Bidu, and to use force if necessary - according to the decision of the judge - but the defendants turned a blind eye to the decision of the court.
The complainant added that he had reported the incident to the police, and he had lodged several complaints to the Public Prosecution Office since the issuance of the verdict, the latest of which was filed on 11/05/2018, where the defendants pledged in writing to abide by the court order. On the same day, however, they proceeded with the construction. The complainant has reported the violation to the police at the same time he has filed this complaint to MUSAWA.
MUSAWA’s intervention:
In view of what has been said, MUSAWA believes that the contents of the complaint, if true, constitute a violation of the Basic Law, the Judicial Authority Law, and the Enforcement Law. In addition, the delay in the implementation of judicial decisions may lead to taking the law into one’s own hands, and undermining their confidence in the judiciary as well as the police. Accordingly, MUSAWA demands that the necessary legal action be taken in this regard, ensuring the implementation of the said court ruling.
