MUSAWA's Statement on the Failure of the Technical Committee to Study the Decree-law Amending the Code of Civil and Commercial Procedure
The Technical Committee Studying the Decree-law Amending the Code of Civil and Commercial Procedure proved being a negotiating committee, and the representatives of official authorities and the High Judicial Council and its supports against the Bar Association, since the representatives of the official authorities rejected the amendments adopted by the Bar Association about the said Decree-law. The official authorities and its representatives clung to a unilateral individualized approach and coercive forceful imposition, in addition to indifference, interest in or approval of the Bar Association’s vision which insisted on adhering to its demands and observations, the thing that proves that the official media efforts and the promotion of the Committee and its role aimed at no more than thwarting the unionist movement of the lawyers, stopping their unionist struggle and making them submissive.
The official aim behind that media campaign promoting the committee and its negotiating position at its meetings not only failed to find an acceptable formula, but also failed and will fail in stooping the Bar’s movement that is supported by the representatives of the widest professional and popular groups, starting from Ramallah to Hebron and today in Nablus, and in front of the Ministers’ Council two days ago, which made it clear far and wide that the lawyers are holding on to the rights of their people to access justice, enjoy fair and genuine trail guarantees that offer a real and serious protection of rights and freedoms.
Failure, although foreseen in the face of official intransigence and firm adherence to individualism, falls under the responsibility of the official level.
There is no alternative to putting Decree-laws aside, being the cause of the problem, and not enforcing them until a consensus thereon is reached.
