After repeating the general elections in Gaza and North Gaza in adherence to the principle of equal representation, maintaining the representation of women in elections and to enhance participation and democracy in the work, which in turn activates the role of the Network and contributes to the fulfilment of its goals, and empowering their role in participation, leadership and decision-making, MUSAWA, in cooperation with the PHRDs Network, conducted the first meeting for the Network’s coordinators in Gaza and North Gaza, in the presence of the female candidates who were unsuccessful in the repeated elections as well as those who were elected. The meeting was held at MUSAWA’s Gaza Office, and was attended by 6 members.<\/p>\r\n\r\n


\r\nThe meeting addressed several topics: evaluating the Network’s general meeting and the mechanism used in holding elections; the tasks assigned to the general coordinators and to the public relations and media coordinators; the Coalition for the Palestinian Human Rights Defenders Declaration (PHRDD); the upcoming activities and joint cooperation; and preparing the Network’s rules of procedure and structure (including legal clinics and monitoring, documenting, and addressing violations against human rights defenders).<\/p>\r\n\r\n


\r\nAt the end of the meeting, participants reached the following conclusions: dividing the members of the PHRDs Network in both Gaza and North Gaza into two groups (A and B) for the purpose of facilitating communications amongst themselves and ensuring that all members will attend the Network’s monthly meetings, which will be held at the headquarters of the relevant institutions in order to strengthen the Network’s relationship with the civil society, hence providing more opportunities for joint cooperation, which will eventually serve as a supporting attribute for the future.<\/p>\r\n\r\n


\r\nThis meeting comes as a part of the Empowering Palestinian Human Rights Defenders project, implemented by MUSAWA in the West Bank and Gaza, and supported by the European Union.

Wednesday 22-02-2017 – Ramallah and Gaza:<\/strong> MUSAWA – The Palestinian Center for the Independence of the Judiciary and the Legal Profession launched the first international conference for Human Rights Defenders (HRDs) in Palestine, in cooperation with the Palestinian Human Rights Defenders’ Network (PHRDs), supported by the European Union (EU). The conference was facilitated via video conference at the hall of the Palestine Red Crescent Society.<\/p>\r\n\r\n


\r\nThe conference, titled “Empowering, Protecting and Activating the Role of Human Rights Defenders”, attracted around 450 male and female participants in the West Bank and Gaza, aiming at empowering HRDs in Palestine while shedding light on the mechanisms available to ensure further protection and enhancement for Palestinian HRDs at the national as well as the international level. <\/p>\r\n\r\n


\r\nThe conference began with welcome notes from the PHRDs’ Network, Bar Association, Independent Commission for Human Rights (ICHR), Press House-Palestine, EU Representative Office, and MUSAWA. In his speech, Vice-Chairman of the Bar, Adv. Hatem Shaheen, said that “in Palestine, it is particularly important to respect human rights, promote the culture of freedom of expression and reinforce the steadfastness of Palestinian citizens, as they suffer from the worst kind of occupation”. <\/p>\r\n\r\n

In his turn, ICHR representative Mr. Mousa Abu-Edheim emphasized that “it is highly essential for legal and human rights institutions to take the rights guaranteed by the UN for all peoples and individuals as the starting point for standing up to the occupation’s discriminatory policies”.
\r\nThis was followed by a short video about the PHRDs’ Network. The conference agenda covered three panels, each of which was followed by a Q&A session. The panels were facilitated by lawyers and legal advisors, in addition to two members of MUSAWA’s staff.  <\/p>\r\n\r\n


\r\nIn the first panel, “The Role and Impact of the PHRDs’ Network”, MUSAWA’s Legal and Technical Adviser, Adv. Ibrahim Barghouthi, discussed the important role the PHRDs’ Network plays in Palestine. Then, two active members of the PHRDs’ Network in the West Bank and Gaza presented their vision, achievements, challenges and ambitions. The session also included EU Programme Manager, Laura Mascagna, who pointed out the EU guidelines and measures for the protection of HRDs.<\/p>\r\n\r\n


\r\nThe second panel, “The Status of PHRDs in International Legislation: Theory vs. Reality”, started with Sahar Francis from Addameer, who brought case studies in reference to the main violations that HRDs face whether by Israeli Occupation Forces or the PA, with specific focus on detention, movement restrictions, administrative detention policies and forced displacement, as well as the legal interventions possible in such cases. The floor was then given to OHCHR Legal Unit Director, Janique Thoele, who talked about international legal tools and mechanisms for protecting HRDs through the Human Rights Council, and their compliance with international treaties and standards. <\/p>\r\n\r\n


\r\nClosing the session, Head of HRDs Global Team Amnesty International, Guadalupe Marengo, spoke about Amnesty’s role in the current global context for documentation and advocacy and its forthcoming campaign for the recognition and protection of HRDs. Ms. Marengo concluded her speech by expressing her pleasure for having taken part in the first conference of the PHRDs’ Network. “Working together against the injustices faced in this context is a must,” she added.<\/p>\r\n\r\n


\r\nIn the third panel, “Tools and Requirements for the Empowerment of PHRDs”, the Board Chairman of the National Society for Democracy and Law, Mr. Ibrahim Muaamar, made reference to the Palestinian Human Rights Defenders Declaration (PHRDD) as part of the policies and procedures which should be adopted to guarantee legal protection for HRDs. Then, a representative of Privacy International, Alexandrine Pirlot De Cornion, addressed the right to privacy and its relation to the work of HRDs: “Protecting Rights, Protecting People”. She stressed that digital rights, with emphasis on the right to privacy, which are now part of the internationally recognized human rights require mobilization from HRDs as well as Civil Society Organization. The panel was closed with a discussion on international lobbying and advocacy as part of the human rights discourse, raised by Falastine Dweikat, a Campaigner at Avaaz. <\/p>\r\n\r\n


\r\nAmnesty International’s representative emphasized the essential role HRDs play in any society by urging all duty bearers in this context to recognise, legitimise and protect HRDs as stated in the 1998 United Nations Declaration on Human Rights Defenders which was adopted by consensus. <\/p>\r\n\r\n


\r\nFurthermore, the office of the EU encouraged Palestinian HRDs to take outreach initiatives to expose to the local donors’ community and to the general public the local human rights situation. On their part, the OHCHR urged the attendees and HRDs all over Palestine to take the Human Rights Council as a platform for the improvement and protection of HRDs in Palestine.<\/p>\r\n\r\n


\r\nThe conference was closed with an intervention by Ms. Dweikat, asking HRDs to benefit from international organizations not only in terms of funding, but also through seeking real political stances towards enhancing the status of HRDs in Palestine. <\/p>\r\n\r\n

\r\nMUSAWA – The Palestinian Center for the Independence of the Judiciary and the Legal Profession held an extended community workshop in Gaza, titled: “Sexual Assaults on Children: Let’s Take Responsibility”.<\/p>\r\n\r\n


\r\nDuring the workshop, seven papers were presented, tackling the reasons behind sexual assault incidents on children and the related consequences, and the actions to be taken at the national level, reaching at a society free of sexual abuse and any violation of children's rights in Palestine. The papers were presented by a variety of specialists from the duty-holders as well as Civil Society Organizations (CSOs) and community figures. The papers reviewed and assessed the reality of childhood in the Gaza Strip and the requirements of maintaining the physical, psychological and mental integrity of children, so that the abuse against children and the violation of their innocence, human dignity, and physical and psychological purity does not evolve into a phenomenon that threatens social unity and distorts the reality and future of our people. At the end, the true wealth of any entity is the human being.<\/p>\r\n\r\n


\r\nOne hundred and fifty-six citizens, including 41 women, took part in the workshop. MUSAWA’s Board member, Adv. Sharhabil Al-Zaeem, gave the opening speech. The discussion was facilitated by Board member, Adv. Islah Hassanieh. In addition, an investigative report on harassment and sexual abuse of children in the Gaza Strip was presented by journalist Amjad Yaghi, a member of the Palestinian Human Rights Defenders’ Network (PHRDs).<\/p>\r\n\r\n


\r\nThe speakers addressed an array of topics, including the role of the judiciary in dealing with sexual abuse of children, presented by Judge Mohammad Abu-Misbeh; the role of the Public Prosecution in addressing cases of sexual abuse of children and dealing with them in legal terms, presented by Mr. Ziyad Al-Namira; and the role of the Bar Association in reducing the incidence of such cases and their contribution to raising legal awareness and the accountability tools they offer to make sure that these cases do not turn into a widely-spread phenomenon, presented by Deputy Chairman of the Bar Adv. Safi Al-Dahdouh. Furthermore, Mukhtar Saif Al-Din Abu-Ramadan, the Head of the Makhateer Association in Palestine (a Mukhtar is the head of a village. Makhateer is the plural of Mukhtar), spoke about the role the Makhateer play as the traditional intermediary between the victim and the offender. This was followed by a speech from media professional and lawyer Kamal Hijazi, who addressed the negative and positive aspects of speaking out on the sexual abuse of children, as a preventive treatment method. The interventions concluded with a paper presented by Specialist Sumaya Karsou’, a member of the AISHA Association for the Protection of Women and Children, which dealt with the cases of sexual assault on children submitted at the Society, and its role in providing psychological treatment to the victims as well as their families.<\/p>\r\n\r\n


\r\nThe conference ended with the announcement of the establishment of a civic coalition comprising of 109 eminent persons and representatives of the institutions participating in the conference, including MUSAWA, Atfaluna Society for Deaf Children, the General Union of Disabled Palestinians, the Makhateer Association in Palestine, Rural Women’s Development Society, Family Development Association, the Center for Women’s Legal Research and Consulting, AISHA Association for Woman and Child Protection, Youth Development Association, the Culture & Free Thought Association, and the Scientific Research & Studies Society. This is in addition to eminent legal and community figures who will stand up to the human dignity of children, make sure that the official institutions meet their obligations, and monitor, document, address and follow up on any violation against Palestinian children, with a view to reaching a society free from child abuse. Accountability mechanisms and tools must be in place to reach this ultimate goal. The coalition will take it upon itself to monitor the performance of the official administrative and executive bodies, ensuring that action is being taken on the ground at the legal, cultural, social, and health levels, to provide a safe and healthy environment for our children as well as their families where they can determine their own fate.<\/p>\r\n\r\n

MUSAWA Concludes Training in Cooperation with Military Justice Commission:
\r\n“Military Court Proceedings through Mock Trials”<\/strong><\/p>\r\n\r\n


\r\nIn cooperation with the Military Justice Commission, MUSAWA – The Palestinian Center for the Independence of the Judiciary and the Legal Profession conducted a training course titled “Military Court Proceedings through Mock Trials”. Twenty-one law students (including thirteen women) from Birzeit University, Al-Quds University, and the Modern University College, as well as three trainee lawyers and recently licensed lawyers, took part in the three-day training, held in March 2018.<\/p>\r\n\r\n


\r\nThe first day of the training was delivered by Assistant Military Attorney General Issa Amro, and was allocated for explaining what a military court is from a theoretical point of view, in addition to addressing military court types and jurisdiction, the link between military courts and regular courts, the proceedings before military courts in terms of law and judicial administration, and the appeal of military court judgments. The participants attended hearings in the military court at the end of day one of the training.
\r\nThe second day, the participants were provided with copies of a closed case, and Chief Military Prosecutors Samer Naser and Numan Fanoun trained the participants on trial proceedings and supervised their performance as they divided roles amongst each other.<\/p>\r\n\r\n


\r\nThe training was concluded on the third day, where a mock trial in the said case was conducted.<\/p>\r\n\r\n


\r\nAt the end of the training course, the participants stressed the need for trainings of this kind, and they recommended continuously involving law students in such activities, particularly moot courts, as an attempt to familiarize the students with the court and its proceedings. <\/p>\r\n\r\n

MUSAWA Organizes a Moot Court Competition on the Sharia Judiciary in Gaza<\/strong><\/p>\r\n\r\n

The Palestinian Center for the Independence of the judiciary and the legal profession –MUSAWA- organized, in cooperation with the Law Faculty at Gaza University and the Sharia Bar association, a moot court competition on the sharia court verdicts in Gaza. The competition took the shape of a realistic practical moot court that simulates the sharia judiciary in Gaza, and it targeted a group of newly licensed lawyers, with an audience of 60 law students of Gaza University, 20 among them were women.<\/p>\r\n\r\n

 <\/p>\r\n\r\n

Two teams were formed, one of them dealt with an alimony case, whereas the other team dealt with a separation on discord and strife case. Prior to the opening of the moot court session, the Legal Awareness and Training officer at MUSAWA, Adv. Momen AlHattab, welcomed the audience, the members of the jury and the two teams, and thanks the administration of the law faculty for hosting them to implement the activity in the moot court hall at the university, and reaffirmed  the importance of the moot court and the legal clinics programs implemented by MUSAWA to develop the lawyers and the law student’s legal skills and to increase their social legal awareness and introduce them to the citizens’ rights, especially the marginalized groups’ rights, and the available legal ways to guarantee these rights, which is a part of MUSAWA’s efforts to ensure that all citizens enjoy their constitutional rights, including the right to equality before the law without discrimination, and the right to access to justice, and the right to enjoy the safeguards of fair trial.<\/p>\r\n\r\n

Right after, Dr. Seif AlDein Albalaawi, the dean of the Law Faculty in the university, and Dr. Ahmad Bdeir, the head of the Sharia Bar Association, gave speeches in which they thanked MUSAWA for its efforts to build the law students’ practical and theoretical capacities, and for its cooperative activities with the association and for implementing the moot court training workshop. <\/p>\r\n\r\n

 <\/p>\r\n\r\n

It is worth mentioning that MUSAWA started implementing the moot court training program during September in cooperation with the Sharia Bar Association. The training hours were 12 consecutive hours, divided on three full days of practice, which included theoretical and practical training on the sharia courts procedures, such as the definition of the suit and the defenses, and the workflow of the procedures of the sharia courts, and the kinds of women suits and an explanation of the mechanism of the alimony case,  and the case of separation on discord and strife, which are the most common cases in the sharia courts in Palestine, and the procedures of arbitration and judgment of such cases and the, in addition, work groups were formed to write and prepare the pleadings, and the teams were given samples of an alimony case of a wife against her husband, and other samples of a separation on discord and strife case.<\/p>\r\n\r\n

After concluding the training session, the alimony and the separation on discord and strife, which both are real cases that were considered by the sharia courts in Gaza, were chosen to be presented before an audience of the law students in Gaza University to share knowledge and to empower MUSAWA’s relationship with the university, and finally to build the legal capacities of the two teams. The training material was lectured by Adv. Ahmad Bdeir, and Adv. Sharif AbuSaad, as they are legal arbitrators in sharia cases, the training took place at the Sharia Bar Association’s hall, MUSAWA’s headquarters in Gaza, and the moot court hall in Gaza University.<\/p>\r\n\r\n

A judgment jury supervised the persecution session implemented by the two teams, and it was composed of Dr. Seif AlDeen AlBalaawi, the law faculty dean in Gaza University, Professor Ahmad AlTarshawi, an academic teacher. The jury announced at the end of the competition, the winning of the team who dealt with the separation on discord and strife case, which was granted an honorary recognition plaque from MUSAWA.<\/p>\r\n\r\n
